Joshua Stokes is a Member in the Los Angeles office of Berry Silberberg Stokes PC. Mr. Stokes has substantial experience representing clients in large, complex commercial litigation, including private antitrust actions under federal law and the Cartwright Act, class actions, Section 17200 cases, intellectual property cases, and other general business litigation. Mr. Stokes has also represented clients in connection with civil and criminal investigations conducted by the U.S. Department of Justice, the Securities and Exchange Commission, and the California Attorney General. He has represented clients in a number of industries including technology companies, health care service companies, health insurers, energy companies, hotel and gaming companies, and entertainment companies. Prior to joining Berry Silberberg Stokes, Mr. Stokes was a partner at Crowell & Moring and an associate at Gibson, Dunn & Crutcher.

Representative Matters:

  • Defended a major chemicals manufacturer against a plaintiff alleging a conspiracy to fix the price of titanium dioxide in violation of Section 1 of the Sherman Act.
  • Defended one of the leading international manufacturers of resistors in a putative class action antitrust case alleging a price-fixing conspiracy.
  • Represented a public university as a plaintiff in an action alleging that several former employees and another university conspired to breach the employees’ fiduciary duties to the client and commit various computer crimes.
  • Represented a public university system in a dispute with a pharmaceutical company regarding sub-licensing income.
  • Represented multiple corporate clients as plaintiffs in one of the largest multi-district litigation antitrust actions in the country alleging that a cartel of major international manufacturers fixed the prices of LCD displays used in computer monitors, laptops, cell phones, and other products.
  • Won dismissal on the pleadings of a putative class action against one of the largest health care services companies in the U.S. The plaintiff alleged that the defendants conspired to limit the territorial distribution rights of certain pharmaceuticals and that the client utilized exclusive dealing contracts to foreclose competition in the market.
  • Represented a large insurance company in an arbitration with providers over compensation for certain medical procedures.
  • Member of the defense trial team in an antitrust class action lawsuit against California’s largest utility and affiliated companies in which the plaintiffs sought over $20 billion in damages. Also represented the company in a contemporaneous investigation by the California Attorney General.
  • Won summary judgment for the leading ticketing services company in a private antitrust action by a competitor alleging monopolization and attempted monopolization through the use of exclusive dealing contracts.
  • Defended a company that hosts televised poker tournaments in an antitrust action brought by seven professional poker players who alleged multiple claims, including tying, group boycott, conspiracy to monopolize, and unreasonable restraint of trade.
  • Represented a client accused of trade secret misappropriation in connection with online software technology.
  • Represented a company in a criminal antitrust and obstruction of justice investigation conducted by the U.S. Department of Justice and a second civil investigation by the Securities and Exchange Commission.

Mr. Stokes received his A.B. in politics from Princeton University in 1994. He received his J.D. from the Duke University School of Law in 2000, where he served as articles editor for the Duke Journal of Comparative and International Law and co-chair of the Moot Court Board. Mr. Stokes clerked for the Honorable Jon P. McCalla in the U.S. District Court for the Western District of Tennessee.  He is licensed to practice in California and Texas.

Mr. Stokes also serves on the Board of Bienvenidos, a family services agency in Los Angeles, and is a member of the Board of Directors of Bet Tzedek Legal Services. He was named a “Rising Star” in Southern California from 2008 to 2012 by Super Lawyers.
